1. Agreement

These Terms and Conditions ("Terms") govern access to and use of Tech Byte POS, including the website, dashboard, POS billing interface, APIs, and related services (collectively, the "Service").

If you use the Service on behalf of a business, you represent that you have authority to bind that business. "You" means the individual or entity using the Service.

2. The Service

Tech Byte POS is a browser-based point-of-sale and back-office platform. Features vary by subscription plan (e.g. Starter, Pro, Enterprise). We may add, change, or discontinue features with reasonable notice where practicable.

We strive for high availability but do not guarantee uninterrupted access. Maintenance, third-party outages, or force majeure may affect the Service.

3. Accounts and workspaces

• You must provide accurate registration information and keep credentials secure.
• Owners are responsible for staff accounts they create and for activity under their workspace.
• Self-serve workspaces require an active paid subscription (via Razorpay) unless we provision access separately as platform admin.
• We may suspend or terminate access for violation of these Terms, non-payment, fraud, or legal requirements.

4. Acceptable use

You agree not to:

• Use the Service for unlawful purposes or in violation of tax, food safety, or other regulations applicable to your business.
• Attempt to breach security, probe systems without authorization, or interfere with other users.
• Upload malware, scrape the Service excessively, or resell access without our written consent.
• Misrepresent your identity or use another party's payment method without permission.

5. Your business data

You retain ownership of menu, order, customer, and other content you submit ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide the Service.

You are responsible for the accuracy of prices, taxes, receipts, and compliance with local laws. The Service provides tools; it does not provide legal, tax, or accounting advice.

6. Subscriptions and fees

• Listed prices are in Indian Rupees (INR) unless stated otherwise. Taxes may apply in addition to displayed amounts.
• Subscriptions renew according to the billing interval you select (monthly or yearly) until cancelled.
• Payments are processed by Razorpay; their terms also apply to payment transactions.
• You may cancel at period end via the subscription page; access continues until the end of the paid period unless otherwise stated.
• We may change pricing for new subscriptions with notice; existing paid periods are generally honored until renewal.
• Refunds are handled according to our Refund & Cancellation policy (/refund-cancellation); contact us for billing disputes.

7. Admin-provisioned access

We may create workspaces without immediate payment for trials, partners, or support. Such access may be revoked or converted to a paid subscription at our discretion.

8. Intellectual property

We own the Service, software, branding, and documentation. These Terms do not grant you rights to our trademarks or source code except as needed to use the Service.

9. Third-party services

Integrations (e.g. Razorpay, Telegram, guest ordering) are subject to third-party terms. We are not responsible for third-party downtime or practices.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.

Our total liability for claims arising from the Service in any twelve-month period is limited to the fees you paid us for that workspace in the twelve months before the claim, or INR 5,000 if you have not paid fees, whichever is greater.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

12. Indemnity

You will indemnify and hold us harmless from claims arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

13. Termination

You may stop using the Service at any time. We may terminate or suspend access with notice where reasonable, or immediately for serious breach or risk.

Upon termination, your right to use the Service ends. Provisions that by nature should survive (fees owed, liability limits, indemnity, governing law) will survive.

14. Governing law and disputes

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to mandatory consumer protections that apply in your jurisdiction.

15. Changes

We may modify these Terms by posting an updated version. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service.
